📋 THE RECRUITER BRIEF · ISSUE 10 · AUGUST 25 2026

You Think You Have Three Months. IND Just Gave You Six.

Most sponsored workers in the Netherlands don't know their search window just doubled.

📌 THIS WEEK IN 60 SECONDS

  • European tech layoffs have already passed all of 2025's total, and LinkedIn and Netflix are now among the companies cutting roles in their Dutch and EU offices (Layoffs.fyi, via Futurism, August 14, 2026; Fast Company, August 24, 2026).

  • The IND extended the highly skilled migrant job-search period from three months to six, effective May 22, 2026, for anyone who has held their permit two years or longer.

  • Your search-period clock starts on your contract end date, not your notice date, and Dutch statutory notice can add up to four extra months first.

  • Recent graduates and orientation-year permit holders can be sponsored at €3,122 a month instead of €5,942, and almost nobody tells them that.

The call came on a Thursday afternoon. His role had just been eliminated. He had no idea what happened to his visa next.

He had already read three expat forums. He had three different answers. All three were wrong, or dangerously incomplete.

I have heard of this exact call more than once this year. The panic is always the same. The actual rule almost never is.

Here is what nobody had told him. The rule changed in May, and it is more generous than he thought. It only works in his favor ifhe understands exactly how the clock runs.

— WHAT CHANGED —

The clock quietly changed in May

European tech has cut more jobs in 2026 than in all of 2025, per the Layoffs.fyi tracker reported by Futurism on August 14, 2026. LinkedIn shut its Israel R&D operation this month. Netflix closed its Helsinki-based Moonloot studio, both confirmed by Fast Company on August 24, 2026.

For sponsored workers in the Netherlands, a layoff used to trigger a hard three-month countdown. As of May 22, 2026, the IND extended that window for permit holders of two years or longer. They now get up to six months to find a new sponsoring employer, not three.

The same extended window applies to victims of labor exploitation. If you have held your permit under two years, the three-month period still applies. Either way, your search period can never run longer than whatever time remains on your current residence permit.

I still hear recruiters and immigration lawyers quote the old three-month rule out of habit. It has been wrong since May.

💡KEY INSIGHT
6 months: the new maximum search period for highly skilled migrants who have held their permit two years or longer.
3 months: the search period if you have held your permit under two years.
0: the number of extra days you get beyond your permit's own expiry date, whichever window applies.”

WHEN DOES THE COUNTDOWN BEGIN

Your notice period is not dead time

The IND countdown does not start the day you are told you are being let go. It starts on the actual end date of your employment contract. That date is set by your statutory notice period under Article 7:672 of the Dutch Civil Code.

Employers must give one month's notice under five years of service. That rises to two months between five and ten years, three months between ten and fifteen years, and four months at fifteen years or more.

A worker with eight years at one Dutch employer gets two extra months of paid runway before the IND clock even starts. That is on top of whichever search window applies once the contract actually ends.

Most candidates never do this math. They panic on day one instead of counting backward from their actual last paid day.

"Your notice period is not lost time. It is runway you are told to ignore."

WHAT HAPPENS WHEN YOU GET ANOTHER OFFER —

A job offer does not stop the clock

A verbal yes from a hiring manager means nothing to the IND. The company hiring you has to be registered as a recognized sponsor, or start that registration before your search period runs out.

The role also has to clear the current salary threshold for your category. For 2026, that is €4,357 a month for highly skilled migrants under 30. It rises to €5,942 a month for those 30 and over, per the IND's own required-amounts table.

I have watched candidates accept verbal offers from companies that were not sponsors. They did not realize the paperwork could take weeks they no longer had.

⚠️ WATCH OUT
A signed offer letter is not the same as a valid sponsorship. Ask whether the company is an IND-recognized sponsor in your first interview, not after you have already turned down other options.

The graduation shortcut almost nobody uses

If you finished your degree, defended a doctorate, or held a Dutch orientation year permit within the last three years, a different rule applies. A new employer only has to meet the reduced salary criterion of €3,122 a month to sponsor you.

That is not the full €5,942 threshold. It is nearly €2,800 less, according to the IND's income requirements page.

This is not a general rule for anyone who gets laid off. It applies specifically to that recent-graduate and orientation-year window.

But if you qualify, it meaningfully widens the pool of companies that can afford to hire you inside your search period. Almost no candidate I talk to knows it applies to them.

💡 KEY INSIGHT
Being within three years of graduation is not just a résumé detail. It can cut the salary bar your next employer has to clear by nearly half.

🎯 FROM THE RECRUITER'S DESK

"Most candidates negotiate their last day like it does not matter. It is the single most important number in your entire search period, and HR will not volunteer that to you unless you ask directly. I have seen two extra weeks of negotiated notice become the difference between a signed contract and a flight home."

WHAT TO DO IF YOU’RE ON A SPONSORED VISA

1. Request your exact contract end date from HR in writing today.

2.Calculate your permit tenure against the May 22, 2026 cutoff to know whether you get three months or six.

3. Check the IND's recognized sponsor register before you accept any verbal offer.

4.  Tell every recruiter in your first conversation if you graduated, defended a doctorate, or held an orientation-year permit within the last three years.

5. Book an appointment with an immigration lawyer or the IND in your first two weeks, not your last two.

— CLOSING THOUGHT —

A layoff in the Netherlands is not the emergency the panic makes it feel like. It is a countdown with real rules, most of which nobody hands you on your way out the door. Know the rules, and you get to run the clock instead of the other way around.
